What makes a lease legally valid in Ontario

In Ontario, tenancy agreements are governed by the Residential Tenancies Act, 2006. Both written and verbal leases are legally valid, but most new tenancies are required to use the government's standard lease form.
Does a Lease Need to Be in Writing?
Not strictly. A verbal tenancy agreement is legally recognised in Ontario, and tenants have full rights under the RTA regardless of whether a written lease exists. However, since April 30, 2018, landlords are required to use the Ontario Standard Lease for most new residential tenancies.
Is There a Standard Form?
Yes. The Ontario Standard Lease is mandatory for most residential tenancies. If a landlord does not provide it when required, the tenant can request it in writing. If the landlord fails to provide the form within 21 days, the tenant may withhold one month's rent. If the landlord still does not provide it within another 21 days, the tenant can keep that withheld rent.
What Must a Lease Include?
A valid lease in Ontario must include the names of the landlord and tenant, the address of the rental unit, the rent amount and payment date, the tenancy start date, and details of any permitted fees or deposits. The lease cannot override any rights protected under the RTA or the Ontario Human Rights Code.
Can a Lease Include Any Terms the Landlord Wants?
No. Any clause that conflicts with the RTA is void and unenforceable, even if the tenant signed it. Common examples of unenforceable clauses include no-pets provisions, requirements to leave at lease end, and waiving the right to a rent receipt.
What Happens When a Fixed-Term Lease Ends?
In Ontario, a fixed-term lease does not end automatically. At the end of the term, the tenancy converts to a month-to-month agreement unless both parties agree otherwise. The tenant's rights and protections continue without interruption.
