In Manitoba, subletting is governed by the Residential Tenancies Act and administered by the Residential Tenancies Branch (RTB). Tenants may sublet their unit, but must follow the correct process and obtain the landlord's consent.

What Is Subletting?

Subletting occurs when a named tenant temporarily vacates their rental unit and allows a subtenant to occupy it for a period while the original lease remains in effect. The original tenant retains responsibility for the tenancy and intends to return when the sublet ends.

Do You Need the Landlord's Permission?

Yes. Subletting in Manitoba requires the landlord's consent. Tenants must notify the landlord and use the official RTB forms when requesting a sublet. An unreasonable refusal or failure to respond by the landlord can have legal consequences for the landlord, according to the Manitoba Residential Tenancies Act. Tenants who believe a refusal is unreasonable can contact the RTB for guidance.

Who Is Responsible During a Sublet?

The original tenant remains fully responsible to the landlord for rent and any damage caused by the subtenant throughout the sublet period. If the subtenant fails to pay or causes damage, the landlord can pursue the original tenant.

What Happens If a Tenant Sublets Without Permission?

Subletting without the landlord's consent is a breach of the tenancy agreement and can give the landlord grounds to end the tenancy. Tenants should always obtain written consent and use the correct RTB forms before allowing a subtenant to move in.

How Are Disputes Resolved?

Disputes about subletting, including unreasonable refusals or unauthorised sublets, can be brought to the RTB. Contact the RTB at 204-945-2476 in Winnipeg, or toll-free at 1-800-782-8403 elsewhere in Manitoba.
