In Manitoba, rent payment rules are set out under the Residential Tenancies Act and administered by the Residential Tenancies Branch (RTB). Both landlords and tenants have clear obligations around when rent is due and what happens if it is not paid.
When Is Rent Due?
Rent is due on the date set out in the tenancy agreement. Tenants must pay the full amount on time each rental period.
Can a Tenant Withhold Rent?
No. Tenants cannot withhold rent to pressure a landlord into making repairs or resolving disputes. Tenants with unresolved issues should apply to the RTB for assistance rather than withholding payment.
Are Receipts Required?
Landlords must provide a receipt for a security deposit. For regular rent payments, receipts are strongly recommended for both parties. Tenants in Manitoba may also need rent receipts for provincial tax benefits, including the Rent Assist program for eligible low-income renters.
What Happens If Rent Goes Unpaid?
A landlord can give a tenant a notice to end the tenancy when the tenant is more than three days late paying rent, according to the Manitoba government. The notice must include the amount owed and advise the tenant that the tenancy will not end if the outstanding rent is paid by the date specified. If the tenant does not pay or vacate, the landlord can apply to the RTB for an order of possession.
Can a Landlord Charge Late Fees?
Late payment fees are not a standard permitted charge under the Residential Tenancies Act. Any such fee would need to be agreed to in the tenancy agreement and be reasonable in amount. Tenants who are charged fees they believe are improper can contact the RTB for guidance.
