Rent payment rules in Ontario: what landlords and tenants need to know
Rent in Ontario is governed by the Residential Tenancies Act and must be paid on the date specified in the lease. In Ontario, rent payment rules are set out under the Residential Tenancies Act, 2006. Both landlords and tenants have obligations around when rent is due, how it is paid, and what steps can be taken if rent goes unpaid.
When Is Rent Due?
Rent is due on the date set out in the tenancy agreement. Tenants must pay the full amount on that date each rental period.
Can a Tenant Withhold Rent?
In almost all circumstances, no. Tenants must continue paying rent even if there are unresolved maintenance issues or disputes with the landlord. Withholding rent without a formal Landlord and Tenant Board (LTB) order permitting it can result in eviction proceedings. The only narrow exception is where a tenant has withheld one month's rent because a landlord failed to provide the mandatory standard lease form within the required timeframe, according to the Ontario government.
Are Receipts Required?
Landlords must provide a rent receipt to a tenant who asks for one. This applies regardless of how rent is paid. Tenants may need receipts for tax purposes, including the Ontario Trillium Benefit.
Can a Landlord Charge Late Fees?
No. Late payment fees are not permitted under the Residential Tenancies Act. Any clause in a lease purporting to charge a penalty for late rent is void and unenforceable.
What Happens if Rent Goes Unpaid?
Under Bill 60, passed November 24, 2025, a landlord can issue an N4 notice after just seven days of unpaid rent. If the tenant does not pay or vacate, the landlord can apply to the LTB for an eviction order.
