Pet rules for rentals in Ontario: what landlords and tenants need to know

Ontario is one of the most pet-friendly provinces for renters in Canada. Under the Residential Tenancies Act, 2006, no-pet clauses in leases are void once a tenancy begins. However, there are important exceptions and limits that both tenants and landlords should understand.
Are No-Pet Clauses Enforceable in Ontario?
No. Under section 14 of the Residential Tenancies Act, any clause in a tenancy agreement that prohibits pets is void. This means a landlord cannot legally enforce a no-pets rule through the lease, even if the tenant signed it.
Can a Landlord Evict a Tenant for Having a Pet?
A landlord cannot evict a tenant simply for having a pet. However, if a specific pet causes damage to the unit, creates unreasonable noise, triggers severe allergic reactions in others, or poses a safety concern, the landlord may have grounds to serve an N5 notice. Each case must be argued on its facts at the Landlord and Tenant Board (LTB).
Are There Any Exceptions?
Yes. Condominium corporations may have their own bylaws that restrict or prohibit pets, and these can override the RTA protections in some circumstances. Tenants in condominiums should review the condo corporation's documents before getting a pet. Municipal bylaws may also restrict certain breeds or species.
Are Pet Deposits Allowed?

Are Service Animals Protected?
Yes. Service animals are not considered pets under the law and cannot be refused under any circumstances. A no-pet clause cannot be applied to a service animal, and no additional fee or deposit can be charged.
