In British Columbia, pet rules in rental housing are governed by the Residential Tenancy Act. Landlords have significant discretion over whether to allow pets, but service animals are protected regardless of any no-pet policy.

Can a Landlord Prohibit Pets?

Yes. B.C. landlords can include no-pet clauses in their tenancy agreements, and these clauses are legally enforceable. Landlords can also set restrictions on the type, size, breed, or number of pets permitted. Tenants who sign a lease with a no-pet clause are legally bound by it.

Can a Landlord Refuse a Service Animal?

No. Tenants who rely on a guide dog or service dog are protected under the Guide Dog and Service Dog Act. A landlord cannot refuse to rent to someone because they have a service animal, apply a no-pet clause to a service animal, or charge a pet deposit for a service animal.

What if a Tenant Gets a Pet in Breach of the Lease?

If a tenant brings a pet into the unit in violation of a no-pet clause, the landlord may have grounds to serve a notice to end the tenancy. The tenant would typically have an opportunity to remedy the breach (by removing the pet) before the landlord can proceed with an eviction application to the Residential Tenancy Branch (RTB).

Yes, in certain circumstances. If a pet causes damage, disturbs other tenants, or poses a safety or health risk, the landlord may have grounds to serve notice. Each case is assessed on its facts through the RTB dispute resolution process.

What About Pet Damage Deposits?
