Can a Landlord Prohibit Pets?
Yes. Alberta landlords can include no-pet clauses in lease agreements and can set restrictions on the type, size, breed, and number of animals permitted. Tenants who sign a lease with a no-pet clause are legally bound by it, according to the Alberta government.
Can a Landlord Refuse a Service Animal?
No. Service animals are protected under Alberta's Service Dogs Act and Human Rights Act. Landlords cannot refuse to rent to a tenant who relies on a service animal, apply a no-pet clause to a service animal, or charge any fee or deposit for a service animal. What if a Tenant Gets a Pet in Breach of the Lease?
If a tenant brings a pet into the unit in violation of a no-pet clause, the landlord may have grounds to issue a notice requiring the tenant to remedy the breach or vacate. Tenants have 14 days to remedy a substantial breach before the landlord can pursue termination through the Residential Tenancy Dispute Resolution Service (RTDRS).
Are Pet Deposits Allowed?
