In Manitoba, completing a move-out condition inspection report is mandatory when a security deposit has been collected, under the Residential Tenancies Act administered by the Residential Tenancies Branch (RTB). The move-out report is compared against the move-in report to determine whether any deposit deductions are justified.

Is a Move-Out Inspection Required in Manitoba?

Yes, when a security deposit has been collected. The RTB Condition Report Form must be completed at both move-in and move-out, according to tenantrights.ca citing the Manitoba Residential Tenancies Act. If the landlord fails to complete the move-out inspection, it may affect their right to claim deductions from the deposit.

Who Must Be Present?

The landlord must offer the tenant at least one reasonable opportunity to attend the move-out inspection, according to tenantrights.ca. Tenants are not required to attend but have the right to be present. Both parties signing the completed report is strongly recommended.

When Should the Inspection Take Place?

The move-out inspection should take place as close to the tenant's move-out date as possible, once the tenant has removed all belongings and cleaned the unit. The landlord must then return the deposit within 14 days if there is no claim, or notify the tenant of any claim within 28 days.

What Can Be Claimed Against the Deposit?

A landlord can only claim against the deposit for damage beyond normal wear and tear. The move-out report, compared against the move-in report and any supporting photos, forms the basis for a valid deduction.
