In Manitoba, pet damage deposit rules are set out under the Residential Tenancies Act and administered by the Residential Tenancies Branch (RTB). Landlords who allow pets can collect a separate pet damage deposit under specific conditions.

Can a Landlord Refuse to Allow Pets?

Yes. Manitoba landlords can include no-pet clauses in tenancy agreements and are not required to permit animals. However, landlords cannot refuse to accommodate tenants who rely on a service animal.

How Much Can a Pet Damage Deposit Be?

For tenancy agreements signed on or after August 1, 2014, the pet damage deposit can be up to one month's rent, according to the Manitoba government. This is separate from the security deposit, which is capped at half of one month's rent. Landlords can only charge one pet damage deposit regardless of the number of pets permitted.

When Can a Pet Damage Deposit Be Collected?

The pet damage deposit must be collected at the start of the tenancy or when the landlord first agrees to permit a pet during the tenancy. Existing tenants who have already paid a pet damage deposit cannot be asked to pay an increased amount if the cap changes.

What Can the Deposit Be Claimed Against?

A pet damage deposit can only be used to cover damage caused by the pet. It cannot be applied to unpaid rent or general damage unrelated to the animal.

When Must the Deposit Be Returned?

If the landlord has no claim, the pet damage deposit must be returned within 14 days of the tenancy ending. If the landlord intends to make a claim, they must notify the tenant within 28 days.

What Can Tenants Do If a Deposit Is Not Returned?

Tenants can apply to the RTB if the deposit is not returned or a deduction is disputed. Contact the RTB at 204-945-2476 in Winnipeg, or toll-free at 1-800-782-8403 elsewhere in Manitoba.
