So when you want to <a href=\"https:\/\/liv.rent\/rental-listings\/city\/toronto\">start renting a place<\/a>, expect to use this contract.<\/p>\n\n\n\n<p>It\u2019s important to know that Ontario recently updated their standard lease in December 2020. Any agreements signed on March 1, 2021, or after have to use this new version. <\/p><br>\n\n\n\n<br><h2 id=\"rental-agreement\">What should be on a rental agreement? <\/h2>\n\n\n\n<p>The Ontario standard lease summarizes all the <a href=\"https:\/\/liv.rent\/blog\/2020\/12\/top-10-tips-for-renting-in-toronto\/\">important info about renting<\/a> a place in one document. <\/p>\n\n\n\n<p>In the order that you find them, here are the 17 sections of the residential tenancy agreement in Ontario and what they mean:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Parties to the agreement<\/h3>\n\n\n\n<p>This part has the legal names of the landlords and <a href=\"https:\/\/liv.rent\/blog\/category\/rental-resources\/tenants\/\">tenants<\/a> (aka, the parties.)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.&nbsp; Rental unit<\/h3>\n\n\n\n<p>This is a description of the residential unit including its address and whether it\u2019s part of a condominium or not. Plus, info about any parking spaces that come with it is here.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.&nbsp; Contact information<\/h3>\n\n\n\n<p>This is where you&#8217;ll find the landlord&#8217;s address, as well as their email address and phone number if they choose to include it. <\/p>\n\n\n\n<p>This is an important section to make note of since it provides a way for the tenant to contact the landlord in case of emergency or to give formal notice. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"term-of-tenancy-agreement\">4. Term of tenancy agreement<\/h3>\n\n\n\n<p>This section states the <a rel=\"noreferrer noopener\" aria-label=\"type of tenancy (opens in a new tab)\" href=\"https:\/\/liv.rent\/blog\/2020\/04\/secure-digital-rental-app-for-tenants-landlords\/\" target=\"_blank\">type of tenancy<\/a> and the start date. The options are fixed-term, month-to-month, or another specified type like daily or weekly.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Rent<\/h3>\n\n\n\n<p>It&#8217;s time to talk money, and the <a href=\"https:\/\/liv.rent\/blog\/2020\/06\/average-rent-near-transit-in-greater-toronto-area-gta\/\">rent<\/a> portion of the lease contract Ontario shows the full amount tenants will pay.<\/p>\n\n\n\n<p>This section also breaks down the total sum owed into base rent and additional charges, including utilities. Also, details on how and when tenants will pay rent are finalized here. Typically, most leases will say that rent will be paid monthly and on the first day of each month, but the options are left open.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Services and utilities<\/h3>\n\n\n\n<p>This is an important piece of the document to pay close attention to because it outlines what\u2019s included in the rent and who\u2019s responsible for what, including: <\/p>\n\n\n\n<ul>\n<li>Gas<\/li>\n\n\n\n<li>Air conditioning<\/li>\n\n\n\n<li>Additional storage space<\/li>\n\n\n\n<li>On-site laundry<\/li>\n\n\n\n<li>Guest parking<\/li>\n\n\n\n<li>Electricity<\/li>\n\n\n\n<li>Heat<\/li>\n\n\n\n<li>Water<\/li>\n<\/ul>\n\n\n\n<p>There\u2019s lots of flexibility in this section and parties can come up with more arrangements and include them in the document here. You can also use the Standard Form Lease Additional Terms Sheet if you need to go into more detail and simply attach it to the document. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. Rent discounts<\/h3>\n\n\n\n<p>Here&#8217;s where the details of any <a href=\"https:\/\/liv.rent\/blog\/2020\/12\/top-property-management-trends-to-know\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"discounts (opens in a new tab)\">discounts<\/a> offered by the landlord are, like if the first month of rent is free, for example.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. Rent deposits<\/h3>\n\n\n\n<p>Both parties agree on the rent <a href=\"https:\/\/liv.rent\/blog\/2018\/12\/deposit-debrief-your-questions-on-security-deposits-answered\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"deposit (opens in a new tab)\">deposit<\/a> and indicate either that it\u2019s not needed or the tenant agrees to pay the set price. <\/p>\n\n\n\n<p>The rent deposit can\u2019t be used as a damage deposit but it can be applied to the rent for the final rental period of the tenancy. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9. Key deposits<\/h3>\n\n\n\n<p>In this section, you\u2019ll either tick the box that says there\u2019s no key deposit or the box that agrees to the landlord\u2019s key deposit rules. <\/p>\n\n\n\n<p>Note: this is refundable and can\u2019t legally be more than the cost of replacing the key.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10. Smoking rules<\/h3>\n\n\n\n<p>This section makes clear that Ontario law prohibits smoking in any indoor common areas, and allows landlords to outline additional rules regarding smoking, if any exist. <\/p>\n\n\n\n<p>If there are special rules about smoking, then they have to <a href=\"https:\/\/www.ontario.ca\/page\/where-you-cant-smoke-or-vape-ontario\">follow the provincial laws<\/a>. Also note that the lease contract Ontario doesn&#8217;t make a distinction between cannabis or tobacco smoke. <\/p>\n\n\n\n<p>That&#8217;s important to note for both landlords and tenants to avoid any miscommunications in the future. Plus, you can always make additional agreements about smoking elsewhere in the document.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11. Tenant Insurance<\/h3>\n\n\n\n<p>Here, landlords will check a box to indicate if insurance is a requirement or not. Tenant insurance isn\u2019t mandatory in Ontario but Landlords can require tenants to have insurance in this section of the lease. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">12. Changes to the rental unit<\/h3>\n\n\n\n<p>In this section, there\u2019s nothing to fill out. It just means that both parties agree that tenants can put up things like pictures on the walls and their own curtains, but they can\u2019t make other changes to the unit without the landlord\u2019s permission.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">13. Maintenance and repairs<\/h3>\n\n\n\n<p>Both parties agree that the landlord has to keep the unit up to standard and the tenant has to keep the place clean. <\/p>\n\n\n\n<p>The tenant also has to pay for any <a href=\"https:\/\/liv.rent\/blog\/2018\/12\/rental-repairs-who-is-responsible-for-what\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"unreasonable damage (opens in a new tab)\">unreasonable damage<\/a> that they or any of their guests cause.&nbsp;<\/p>\n\n\n\n<p>There\u2019s nothing to fill out here, but there\u2019s more about the breakdown of responsibilities in the document\u2019s \u201cPart J\u201d in General information. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">14. Assignment and subletting<\/h3>\n\n\n\n<p>Both parties agree that if there will be subletting, that it&#8217;s subject to the landlord&#8217;s approval. There\u2019s nothing to fill out here, but it does defer parties to the General Information for additional rules regarding subletting.<br><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">15. Additional terms<\/h3>\n\n\n\n<p>Here, landlords can add additional specifications to the agreement that aren&#8217;t contained in the standard lease contract in Ontario.  Parties will attach them as a separate document.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">16. Changes to this agreement<\/h3>\n\n\n\n<p>Agreeing to this section means that in the future if this document is going to be changed in any way, then both parties must agree to it in writing. There\u2019s nothing to fill out here. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> 17. Signatures<\/h3>\n\n\n\n<p>Everyone named in section one, meaning all landlords and tenants in the agreement, must sign the document.<\/p>\n\n\n\n<p>This indicates that they\u2019re agreeing to follow the terms laid out inside. Also, if both parties agree to it, this document can also be <a href=\"https:\/\/liv.rent\/blog\/2019\/03\/why-paperless-property-management\/\">signed electronically<\/a>.<\/p>\n\n\n\n<br><h2 id=\"add-to-form\">What can I add to my Ontario standard lease form?<\/h2>\n\n\n\n<p>While we would not go so far as to say that it\u2019s customizable, there are things you can add.<\/p>\n\n\n\n<p>Section 15 is called \u201cAdditional Terms\u201d and you\u2019ll find two boxes to tick. Basically, these boxes indicate whether or not there are any additional terms to the lease.<\/p>\n\n\n\n<p>\n\nIf they have decided to add any, these will be included as an attachment to the document. Examples can include things like:\n\n<\/p>\n\n\n\n<ul>\n<li>How to use common spaces or amenities<\/li>\n\n\n\n<li>Making landlords update the unit prior to the move-in date  <\/li>\n<\/ul>\n\n\n\n<br><h2 id=\"not-allowed\">What&#8217;s not allowed on a lease?<\/h2>\n\n\n\n<p>There are also lots of things that can\u2019t be added as a special term. Anything that would take away rights or responsibilities that are protected by <a rel=\"noreferrer noopener\" aria-label=\"Ontario\u2019s Residential Tenancies Act (opens in a new tab)\" href=\"https:\/\/www.ontario.ca\/laws\/statute\/06r17\" target=\"_blank\">Ontario\u2019s Residential Tenancies Act<\/a> and the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90h19\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Ontario Human Rights Code (opens in a new tab)\">Ontario Human Rights Code<\/a> are not allowed. This could include things like:<br><\/p>\n\n\n\n<ul>\n<li> <a href=\"https:\/\/liv.rent\/rental-listings\/city\/toronto?pet_policy=ALLOWED&amp;page=1\">Pet policies<\/a> that ban pets (except when they must follow condo rules)<\/li>\n\n\n\n<li> Refusing to allow guests or roommates <\/li>\n\n\n\n<li> Asking the tenant for money that\u2019s not mentioned in the standard agreement <\/li>\n\n\n\n<li> Asking the tenant to pay for repairs that are the landlord\u2019s responsibility <\/li>\n<\/ul>\n\n\n\n<p>If a landlord puts something in here that isn\u2019t legal, then it won\u2019t be binding. As a renter, it\u2019s a good idea to look closely at this section.<\/p>\n\n\n\n<p>As a landlord, if you decide to add additional terms, we\u2019d recommend getting your lawyer to take a look at them before you sign the contract.&nbsp;<\/p>\n\n\n\n<p>The Ontario standard lease agreement is still relatively new. It\u2019s only been around since 2018. All residential tenancies in the private rental market that started on or after April 30, 2018, are required to have a lease contract in Ontario.\u00a0<br>There are a few places where it is not used, like:<\/p>\n\n\n\n<ul>\n<li> Care homes and mobile home spots <\/li>\n\n\n\n<li> Social, supportive, or co-op housing <\/li>\n\n\n\n<li> Land lease communities <\/li>\n<\/ul>\n\n\n\n<p>Landlords have 21 days to get tenants a copy of the standard lease after it\u2019s been signed.<\/p>\n\n\n\n<p>For a mandatory document, it\u2019s pretty easy to follow.  They designed it to be simple to read and understand.<\/p>\n\n\n\n<br><h2 id=\"languages\">Does the Ontario standard lease come in other languages?<\/h2>\n\n\n\n<p>The lease comes in English or French. However, Ontario also made <a href=\"https:\/\/www.ontario.ca\/page\/guide-ontarios-standard-lease\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">guides to understanding<\/a> their standard lease available in 21 languages. The difference is that month-to-month contracts have no set \u201cend\u201d date. <\/p>\n\n\n\n<p>Many fixed-term leases are often a year-long, for example, and they called it \u201cfixed\u201d because they\u2019ve agreed to specific start and end dates.<\/p>\n\n\n\n<p>But just because a term ends, tenants don\u2019t have to leave. When a lease ends in Ontario, the tenant will automatically transition to a monthly tenant.&nbsp;<br><\/p>\n\n\n\n<p>Everything inside the original signed Ontario standard lease form still applies. This is great because you won\u2019t need to sign a new lease, you can keep the old one and it\u2019s still valid.&nbsp;<br><\/p>\n\n\n\n<p>We\u2019d definitely encourage you to slow down and take <a href=\"#term-of-tenancy-agreement\">Section 4<\/a>, the \u201cTerm of Tenancy Agreement\u201d seriously.
