Thankfully, the province has provided clear guidelines for practically every stage of the rental process and codified these in the form of tenancy forms. In this post, we&#8217;re going to look at the types of tenancy forms you&#8217;ll encounter in B.C. and show you how to manage them online or in the <a href=\"https:\/\/liv.rent\">liv.rent<\/a> app.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-is\">2024 Updates to the Residential Tenancy Act<\/h2>\n\n\n\n<p>A new bill has been introduced and has made some changes to the Residential Tenancy Act. Residential Tenancy Agreement<\/h3>\n\n\n\n<p>The <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb1c.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Residential Tenancy Agreement<\/a> is the most important document for landlords and tenants in BC. It serves as the legally binding contract between a landlord and a tenant as well as outlining the terms of the tenancy. It is a mandatory contract that is signed by both landlord and tenant and typically includes specifics like duration of the rental, rental rate, payment terms, and restrictions (i.e. pets, subletting, etc.). Ending your tenancy agreement<\/h3>\n\n\n\n<p>A tenancy can end for a variety of <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www2.gov.bc.ca\/gov\/content\/housing-tenancy\/residential-tenancies\/ending-a-tenancy\" target=\"_blank\">reasons<\/a>. As a result, the BC government has 6 separate forms to address the different circumstances surrounding the end of a tenancy agreement when initiated by the landlord:<\/p>\n\n\n\n<p>1. <strong><a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb30.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">10-Day Notice to End Tenancy for Unpaid Rent or Utilities<\/a><\/strong> &#8211; This can be served to tenants who do not pay the full rent or utilities when they are due.\u00a0<\/p>\n\n\n\n<p>2. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb33.pdf\" target=\"_blank\">One Month Notice to End Tenancy<\/a><\/strong> &#8211; This is applicable when the tenant has missed rent payments, caused damage to the property, disrupted the neighbourhood\/other tenants, provided false information or sublet the unit unlawfully. <\/p>\n\n\n\n<p>3. <a rel=\"noreferrer noopener\" style=\"font-weight: bold;\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb32.pdf\" target=\"_blank\">Two Month Notice to End Tenancy<\/a><strong>&nbsp;<\/strong>&#8211; This applies when the landlord or close family member intends to move into the unit or the property is sold to a new owner who will live in the unit. <\/p>\n\n\n\n<p>4. <strong><a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb29.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Four-Month Notice to End Tenancy<\/a>\u00a0<\/strong>&#8211; This applies to the demolition, renovation, or conversion of the rental unit to another use. This lengthier notice is required to be provided when construction plans dictate.<\/p>\n\n\n\n<p>5. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb8.pdf\" target=\"_blank\">Mutual Agreement to End a Tenancy<\/a><\/strong> &#8211; This is used when the landlord and tenant mutually agree to end a tenancy.<\/p>\n\n\n\n<p>6. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb34.pdf\" target=\"_blank\">Proof of Service Notice to End Tenancy and Written Demand to Pay Utilities<\/a><\/strong>&nbsp;&#8211; This notice is served prior to the 10-day notice giving tenants an opportunity to settle their utility accounts if they have fallen into arrears. Dispute resolution<\/h3>\n\n\n\n<p>For landlords, there are four <a href=\"https:\/\/liv.rent\/blog\/2019\/12\/how-to-dispute-resolution\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Dispute Resolution (opens in a new tab)\">Dispute Resolution<\/a> forms they can use:<\/p>\n\n\n\n<p>1. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb12lct.pdf\" target=\"_blank\">Landlord&nbsp;Application for Dispute Resolution &#8211; Current Tenancy<\/a><\/strong> &#8211; used when tenants are currently living in a unit and a residential tenancy dispute must be resolved.<\/p>\n\n\n\n<p>2. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb12lpt.pdf\" target=\"_blank\">Landlord&nbsp;Application for Dispute Resolution_- Past Tenancy<\/a>&nbsp;<\/strong>&#8211; employed when the tenants are no longer living in the unit but a dispute resolution regarding their past tenancy is required.<\/p>\n\n\n\n<p>3. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb12lexh.pdf\" target=\"_blank\">Landlord&nbsp;Application for Dispute Resolution &#8211; Expedited Hearing<\/a>&nbsp;<\/strong>&#8211; if the landlord requires an expedited hearing for an emergency matter, this is the form that must be completed and submitted.<\/p>\n\n\n\n<p>4. <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb12lo.pdf\" target=\"_blank\">Landlord&nbsp;Application for Dispute Resolution &#8211; Other<\/a>&nbsp;<\/strong>&#8211;  for extreme circumstances when the landlord is applying for possession of a rental unit because it has become uninhabitable or for an issue not found on the Landlord\u2019s Application for Dispute Resolution. Condition Inspection Report<\/h3>\n\n\n\n<p>When a new tenant moves into a rental property, the landlord is obligated to walk through the unit with the tenant, reviewing all the items listed on the <a href=\"http:\/\/www2.gov.bc.ca\/gov\/DownloadAsset?assetId=49D61654DE974CAF93E29F853FECA93B&amp;filename=rtb27.pdf\">Condition Inspection Report<\/a> and making note of items that aren&#8217;t functioning properly or any pre-existing damage. All issues should be recorded in the Condition Inspection Report document. This protects both the landlord and tenant from unfounded allegations of damage.
